The GSTN has issued an important clarification regarding the “Tax Liability Breakup, As Applicable” tab in GSTR-3B. This update directly impacts how taxpayers report and confirm tax liabilities, especially those related to previous tax periods.
This change is part of the ongoing effort to improve accuracy, transparency, and interest computation under GST law.

As per Section 50 of the CGST Act, 2017:
- Interest is payable when:
- Tax liability of a previous tax period
- Is discharged in a later tax period
👉 Therefore, correct identification of such delayed liabilities becomes crucial.
🧩 What is “Tax Liability Breakup, As Applicable”?
This tab in GSTR-3B is used to:
- Identify tax liabilities belonging to earlier periods
- Which are:
- Reported now (in current return)
- Paid now (in current GSTR-3B)
📌 In simple terms:
It separates current period liability vs past period liability.
⚙️ Key Changes from February 2026
🔹 1. Auto-Population by GST Portal
From February 2026 onwards, GST Portal will:
- Automatically populate this breakup
- Based on:
- Document dates in:
- GSTR-1
- GSTR-1A
- IFF (Invoice Furnishing Facility)
- Document dates in:
👉 If invoices belong to an earlier period, but are reported now, system will detect and reflect it.
🔹 2. Mandatory Confirmation Before Filing GSTR-3B
After offsetting tax liability:
- Taxpayer must:
- Open “Tax Liability Breakup” tab
- Click SAVE
OR
- Edit the breakup (if required)
- Then save
📌 Only after this step:
- GSTR-3B filing (via EVC / DSC) will be allowed
🔹 3. System Issue (Current Practical Difficulty)
GSTN has acknowledged a major concern:
👉 Currently, confirmation is required in ALL cases, even when:
- There is no past period liability
- Entire liability belongs to current period
📌 Ideally, it should apply only where past liabilities exist
🔹 4. Interim Solution (Important for Filing)
Until system correction:
✔ Taxpayers must:
- Open the tab
- Click SAVE (even if no change required)
👉 This is mandatory to proceed with filing GSTR-3B
